Buying on the Costa Blanca (hereafter «we», «ACB») places great importance on the protection of your privacy. This statement sets out our privacy policy, that is, the processing of personal data collected through our website or online services, or more generally, as part of the services we provide.

We collect and process your personal data with the utmost care and in compliance with applicable legal provisions. Their treatment is limited to what is strictly necessary and only for the purposes described in this declaration. We store your personal data only for the period necessary for the provision of our services or for the period prescribed by law. In close collaboration with our hosting companies, we make every effort to protect our data banks from external intrusions, losses, misuse and falsification.

This declaration is based on the European Data Protection Regulation (GDPR). Although the GDPR is an EU regulation, Swiss data protection law is strongly influenced by EU law, and companies outside the EU or EEA are required, in some cases, to comply with the GDPR.

Your data is processed by ACB which is the Controller.

What data do we collect?

It depends on the nature of our relationship.

As a user of our site, we store information about your use (IP address, date and time, page visited, etc.), and we also store cookies (see the page on cookies used on our site). We use Google Analytics technology (Google Inc.,1600 Amphitheatre Parkway, Mountain View, CA 94043, USA). We use this technology to measure visitor response to our site and to evaluate the use of our website (including the number of times a page has been opened and the information accessed). If you have a personal account, we will store the necessary information.

As a user of our contact form, we store personal information, such as:

  • your name and e-mail address.

As a user of our information request form for a specific property, we store personal information, such as:

  • your name, phone number and email address.

As a requester of a commented visit, you are required to create a visit account for which we record personal information, such as:

  • your first and last name, telephone number, e-mail address and address.

How do we use this information?

We perform all our processing on a legal basis, corresponding to (at least) one of the following categories:

  • your consent, or your explicit consent,
  • compliance with a legal, regulatory or contractual requirement,
  • our legitimate interests, as described in the next section.

What are our legitimate interests?

As Data Controller, ACB may process personal information for legitimate business purposes, including:

  • the analysis, optimization, development or, in general, modification of our services;
  • identification and prevention of fraud;
  • improving the security of our network and information systems;
  • better understanding of our visitors' interactions with our website.

Whenever we process data for these purposes, we carefully ensure that your rights are taken into account and respected. You have the right to object to such processing, and to know how to exercise this right, please refer to the section How to exercise your rights below.

How long do we keep your personal data?

We store personal data in our systems as long as it is necessary for our processing and to fulfil our legal obligations. We determine this period of time by considering:

  • the need to have the data to provide you with the agreed services
  • our legitimate interests, as described in this document
  • compliance with your legal obligations in the context of a commented visit.

What information do we share?

We do not disclose the personal data we collect about you, except in the cases described in this privacy clause.

In addition, we may disclose personal data about you if required to do so by law or legal procedure; to law enforcement authorities or on the basis of a legal request for disclosure; and where we believe disclosure is appropriate to prevent bodily harm, damage or financial loss, or as part of an investigation into alleged illegal or fraudulent activities.

We also reserve the right to transfer your personal data in the event of a total or partial sale of our business or assets (including in the event of reorganization, dissolution or liquidation).

How do we protect your personal data?

We use appropriate technical, administrative and physical security measures to protect the information collected on this website. Unfortunately, no organization is able to guarantee absolute security in terms of information, especially for information exchanged on the Internet.

Do we transfer your data abroad?

Your personal data is hosted in Switzerland and processed in Spain.

Your personal data is not transmitted, sold or otherwise transferred to third parties, unless it is necessary for the performance of our legal obligations or you have expressly consented to it. ACB may also transfer data to third parties in so far as it is required to do so by legal provisions or by administrative or judicial decision.

What are your rights?

The legal framework gives you several rights regarding your personal data:

  • Right of access and right of rectification: You have the right to access your personal data to verify that it is processed in accordance with the law. You also have the right to have your personal data corrected or completed in order to ensure the accuracy of the processing.
  • Right to erasure (“right to be forgotten”), and right to limitation of processing: you have the right to ask us to delete your personal data, or to stop processing them if we are unable to delete them. In the context of guided visits, this right is applicable 24 months after receipt of the file.
  • Right to object: you have the right to object at any time to our processing of your personal data, for reasons set out in the law and to compliance with the conditions issued during the solicitation of commented visits, without having to justify your decision.
  • Right to object to decisions taken by automated means:  typically the use of cookies.

When the processing is based on your consent, you have the right to withdraw your consent at any time with effect for the future.
